The bail hearing of the six men @ccused of the murd3r of Kaizer Chiefs defender, Luke Fleurs, has been postponed due to the unavailability of the investigating officer, Sergeant Nare Moloto.
NPA spokesperson Phindi Mjonondwane said the state will oppose bail because they are still busy with the investigation. “The state was still busy with its evidence in opposing the release of the accused on bail. Hence, the court has now requested the investigating officer to give evidence. If you recall, we tendered an affidavit of the investigating officer. Emanating from that affidavit, the court requested him to attend today’s proceedings so that the court can be in a position to ask certain questions regarding issues that are left unclear,” she said.
In the previous appearance, the State Prosecutor Shadrack Temeki read an affidavit from Moloto which states that cellphone records show that an unknown person told @ccused number 4, Franky Xaba, that if they were to be arrested for the crime, they should confess to protect the actual suspects’ identity. “During the arrest, Xaba’s mobile phone was seized and communication with an unknown person was discovered.
The communication was to the effect that if the applicants get arrested, they must confess to the crime because they do not want their names to come out as they will also be arrested,’ the affidavit read. Fleurs was sh0t and k!lled four weeks ago by armed men at a filling station in Roodepoort. Ndumiso Ndura Moswane (26), Fernando Nando Sive (25) Nhlakanipho Dlamini (21) Franky Xaba (25), Maredi Mphahlele (36) and Thembinkosi Hlomikhawu (31) are facing charges of murd3r, r0bbery with aggravating circumstances and defeating the ends of justice.
