In a shocking twist, Bona Mugabe, daughter of the late President Robert Mugabe, has emerged victorious in a High Court ruling allowing her to proceed with both her annulment and divorce applications concurrently. The ruling has left many scratching their heads, wondering what will happen next in this messy divorce saga.
Bona’s estranged husband, Simbarashe Mutsahuni Chikore, had been playing the role of the villain, allegedly bigamously marrying Bona while still being married to Margaret Jeanine Brooks in the United States. The plot thickens! Chikore’s lawyer argued that Bona couldn’t seek annulment and divorce in the same case, claiming it was like trying to have one’s cake and eat it too.
Justice Amy Tsanga’s ruling was a game-changer, dismissing Chikore’s exception and allowing Bona to proceed with her claims. The judge noted that a marriage entered into while one party is already married is legally void, supporting Bona’s primary claim for annulment. “While it is generally not the norm to have two causes of action in divorce summons, the ends of justice would be better served by allowing the two actions to be pleaded in the alternative,” she stated.
With the exception dismissed, Chikore was ordered to file his plea to the amended summons within five business days. Costs were reserved to follow the outcome of the case. Will Bona finally get her happy ending, or will Chikore find a way to delay the proceedings further?
