He alleged that James deceitfully changed the ownership of their family property in Mbare to his name without acknowledging Mudzingwa’s existence as a surviving heir.
In his application, Mudzingwa is seeking a court order to declare the estate process initiated by James as null and void, asserting that his brother falsely represented himself as the sole surviving child to the Master of the High Court, thereby unlawfully claiming full ownership of the property.
This claim surfaced when Mudzingwa received an eviction notice from James, who justified the move by stating that the family intended to renovate the house.
Further investigation revealed that the house was registered under James’s name—contrary to Mudzingwa’s understanding of their family’s structure—and that James had misrepresented the estate’s beneficiaries in legal documents filed with the court.
Mudzingwa argues that since he has been residing in the family home since their mother’s passing, James’s claims are fraudulent and thus any judgment based on those misrepresentations is invalid and should be overturned.
The matter remains unresolved as the court reviews Mudzingwa’s application.
