Francesco Marconati, a Marondera businessman, has been found guilty of fraud after deceivingly removing his partner, Ms. Song, from the directorship of Eagle Italian Shoes.
Marconati appeared before Harare Magistrate Donald Ndirowei and was convicted on two counts of fraud.
According to media reports, the court ruled that Marconati had illegally removed Ms. Song from the company’s directorship and as secretary of Agrilink by falsifying documents that claimed she and Agrilink had resigned.
However, the State, represented by Anesu Chirenji, proved that Marconati had provided false information to the registrar of companies, stating that Ms. Song had resigned when, in fact, she had not.
The magistrate noted that Marconati had submitted fake documents to Ecobank and First Capital Bank to remove Ms. Song as a company director and signatory, replacing her with his son Alessandro.
He did not follow proper procedures, failed to hold a general meeting or shareholders meeting, and did not inform Ms. Song of the changes.
Additionally, Marconati fraudulently appointed his son as director and later added Kutaura Bond as an extra company director using forged documents.
