A Kwekwe businessman has been dragged to court for failing to settle US$5 500 owed to his counterpart.
In an application filed at the Kwekwe magistrates court, Tyson Gore through his lawyers from Mavhiringidze and Mashanyare Legal Practitioners submitted that on 4 May this year,Courage Mugabe borrowed US$5 500.
Courage, son to popular Cleric, Bishop Kandros Mugabe, leader of Zvipozvomweya Apostolic Church based in Kwekwe is a gold buyer and proprietor of Manyama Butchery.
Gore said Courage signed a written acknowledgement of debt in terms of which he acknowledged his indebtedness to him and undertook to repay the amount on 5 June 2023.
However, Courage has failed to make any payments, prompting Gore to seek legal action.
“On 4 May 2023 the respondent acknowledged being indebted to me in the sum of US$5 500. I advanced the money to the respondent at his own specific instance and request.
“…the respondent undertook to pay the debt on the 5th of June 2023,” Gore’s papers read in part.
He said in breach of the agreement, the respondent has not fulfilled his obligation.
He also stated that he has made several attempts to collect the debt from Courage, but to no avail.
“The only remedy available to me is to approach this honourable court to recover my debt. I sincerely believe there are no disputes of facts in this matter and the matter can be disposed of on papers.
“The respondent has failed, neglected and or refused to pay the same despite demand,” said Gore.
Gore is now praying for a summary judgment compelling Courage to pay back the money.
