PROMINENT lawyer Norman Mugiya appeared at the Harare Magistrates Court on Tuesday charged with theft of trust property.
Mugiya appeared before magistrate Ntombizodwa Sibanda who remanded him to today for trial.
The complainant is Nyarai Chinguruwe of Mufakose, Harare.
Allegations are that sometime in 2017, the complainant engaged Mugiya’s law firm to recover her late husband’s outstanding salary amounting to US$2 175 from Kingstone (Pvt)Ltd.
Mugiya won the court order under case number HC7676/17.
In a bid to recover the aforementioned money, stationery of an undisclosed value was attached as per removal assessment form dated November 9, 2018.
Mugiya made the complainant pay fees amounting to US$540 which was required by the Deputy Sheriff for the execution of the award order.
The accused then asked the complainant to supply him with her banking details to deposit the money from the anticipated auction of the attached stationery.
However no funds were deposited into her bank account.
She then proceeded to the High Court where she was told that she did not pay the required US$540 removal fees.
Investigations revealed that the said property was attached, but was not removed as the complainant had not paid the removal fees.
Total value stolen is US$540.
