Daniel Simango, a 44-year-old security guard from Mukono village in Chipinge, has been convicted by the Chipinge Magistrates’ Court for negligently causing bodily harm to a 10-year-old boy.
The incident occurred on October 12, 2024, when the young complainant, along with his friends, attempted to steal macadamia nuts from a farm.
To circumvent the farm’s perimeter, the boys stretched the fence to gain unauthorized access.
Upon discovering the intruders, Simango approached them with his dog, which he subsequently released from its leash.
The dog att@cked the boys, biting the complainant multiple times on his left thigh and private parts, resulting in severe injur!es.
Medical examinations revealed that the boy had sustained significant harm, which necessitated treatment.
In court, the prosecution argued that Simango’s failure to control his dog constituted negligence, especially in a situation where he should have anticipated potential harm to trespassers.
After considering the circumstances, the magistrate sentenced Simango to 14 months in prison; however, half of that time , 7 months was suspended for five years, contingent on his good behavior.
Furthermore, he was required to complete 245 hours of community service, thus allowing him to contribute positively to the community while addressing the consequences of his actions.
